About the gallery

Colin Cesvette Online Gallery offers original artwork, limited edition prints, open edition prints, and bespoke commissioned artwork for private and commercial customers.

Products & Artwork

• Orders are subject to acceptance and availability.
• After placing an order, you will receive an order confirmation email. This does not guarantee acceptance.
• We reserve the right to cancel or refuse any order where pricing errors, stock issues, suspected fraud, or technical errors occur.
• If payment has been taken for a cancelled order, a full refund will be issued.

Prices & Payment

• All prices are shown in GBP (£) unless otherwise stated.
• Prices may change at any time without notice.
• Secure payment methods may include credit/debit card, PayPal, Stripe, Apple Pay, Google Pay, Klarna, or other payment providers shown at checkout.
• Payment must be received in full before dispatch unless an agreed staged payment plan applies to commissions.
• Customers are responsible for any customs duties, import taxes, or local fees for international orders.

Delivery & Shipping

• Delivery times are estimates only and are not guaranteed.
• We aim to dispatch orders promptly, but delays may occur due to demand, courier issues, weather, customs, or events beyond our control.
• Risk in the goods passes to the customer on confirmed delivery to the delivery address provided.
• Customers must ensure delivery details are correct at checkout.
• If an item arrives damaged, customers must notify us within 48 hours of delivery with photographs of the packaging and item.
• We are not responsible for delays or losses caused by incorrect addresses supplied by the customer.

Quality Assurance

• We take care to ensure artwork and prints meet a high standard of quality before dispatch.
• Print production may be fulfilled directly or through trusted professional print partners.
• If an item is defective, damaged in production, or materially different from its description, please contact us promptly so we can review and resolve the issue.
• Remedies may include replacement, repair, store credit, or refund at our discretion and in line with applicable consumer law.

Returns & Refunds

• Where items are made to order or personalised, returns may not be accepted unless faulty or damaged.
• Standard non-custom items may be returned within 14 days of delivery, unused and in original condition, unless excluded by law.
• Customers are responsible for return shipping costs unless the item is faulty or incorrect.
• Refunds will be processed after inspection of the returned item.
• We reserve the right to reduce refunds where returned items show signs of use or damage.

Commissions (Bespoke Artwork)

Consultation & Scope

• Commission projects begin with an agreed brief covering subject, size, style, colours, deadlines, and budget.
• The artist retains creative interpretation unless otherwise agreed in writing.

Deposits & Payments

• A non-refundable deposit (normally 50%) may be required before work begins.
• Work will not commence until the deposit has cleared.
• Final payment is due before dispatch or release of high-resolution files.

Revisions

• Reasonable minor revisions may be included if agreed during the brief stage.
• Major changes, change of direction, or repeated revisions may incur additional charges and revised timelines.

Timescales

Completion dates are estimates only and depend on workload, complexity, approvals, and circumstances outside our control.

Cancellations

• If the customer cancels after work has started, the deposit is non-refundable.
• If substantial work has already been completed, further payment may be required for time and materials already committed.

Approval & Delivery

Customers should review previews carefully. Once final approval is given, responsibility for spelling, content accuracy, and design acceptance passes to the customer.

Intellectual Property

• All artwork, designs, images, text, and branding remain the intellectual property of Colin Cesvette unless expressly assigned in writing.
• Purchasing artwork does not transfer copyright.
• Artwork may not be copied, reproduced, resold, distributed, minted as NFTs, or used commercially without written permission.
• We may use images of completed commissions for portfolio, website, or promotional purposes unless confidentiality is agreed in writing beforehand.

Website Use

• You agree not to misuse the website, attempt unauthorised access, upload harmful material, or interfere with site functionality.
• We may suspend or withdraw the website without notice for maintenance, updates, or security reasons.

Limitation of Liability

• To the fullest extent permitted by law, our liability is limited to the amount paid for the relevant order.
• We are not liable for indirect, incidental, or consequential losses including loss of profit, business interruption, emotional disappointment, or third-party costs.
• Nothing in these terms excludes rights that cannot legally be excluded, including applicable consumer protections.

Force Majeure

We are not responsible for failure or delay caused by events outside reasonable control, including strikes, transport disruption, supply shortages, illness, accidents, cyber incidents, natural events, or government restrictions.

Privacy

Any personal data submitted through the website will be handled in accordance with the website Privacy Policy and applicable data protection laws.

Governing Law
